11-Month Rent Agreement: Why 11 Months & Is It Legal?
Why most rent agreements are for 11 months, whether they're legal, what stamp duty you pay, when registration is compulsory, and the clauses to include.
If you've rented a house in India, you've almost certainly signed an 11-month rent agreement. It's so common that many people think it's a legal rule. It isn't — it's a practical choice that comes from how registration law works. This guide explains why 11 months is so popular, whether it protects you, and what to put in it.
Why 11 months?
Under Section 17 of the Registration Act, 1908, a lease of immovable property for more than one year must be registered at the sub-registrar's office. Registration means paying registration fees and usually higher stamp duty, and both parties visiting the office.
A lease of less than 12 months doesn't need compulsory registration in most states. So landlords and tenants choose 11 months to:
- avoid the registration visit and fees
- pay a small fixed stamp duty instead of a percentage of rent
- keep flexibility to renegotiate rent every year
Is an 11-month agreement legal?
Yes. An unregistered 11-month agreement on proper stamp paper is a valid contract between landlord and tenant. Courts accept it as evidence of the tenancy and its terms.
But there are two important limits:
1. It must be properly stamped. An agreement on plain paper, or on stamp paper of too low a value, can't be used as evidence until the stamp duty and a penalty are paid.
2. Some states require registration anyway. In Maharashtra, every leave-and-licence agreement must be registered, whatever its length (Section 55 of the Maharashtra Rent Control Act, 1999) — luckily, you can do it online through the IGR portal. Tamil Nadu's 2017 tenancy law requires every tenancy to be registered with the Rent Authority.
How much stamp duty do you pay?
Stamp duty on rent agreements is set by each state. For an 11-month agreement, it's often a small fixed amount (₹100–₹500) or a small percentage of the total rent. Some states also include the security deposit in the calculation.
Buy e-stamp paper through SHCIL (Stock Holding Corporation) or your state's e-stamp portal. It's safer than old physical stamp paper and can be verified online.
Clauses every rent agreement should have
- Names and addresses of landlord and tenant, with ID details
- Property description — address, floor, area and fittings
- Rent amount and due date, and how it's paid (bank transfer is best)
- Security deposit amount and the conditions and timeline for refund
- Rent increase — for example 5% at renewal
- Maintenance and repairs — who pays for what
- Lock-in period, if any, and the notice period (usually one month)
- Utilities — electricity, water, society maintenance
- Use of property — residential only, number of occupants, pets
- Inventory of furniture and appliances
Both parties and two witnesses should sign every page.
Don't forget police verification
Many cities require landlords to submit tenant police verification. In Delhi, Mumbai, Bengaluru and many other cities, it can be done online through the city police website or app. Skipping it can lead to a fine for the landlord.
What the Model Tenancy Act changes
The central Model Tenancy Act, 2021 suggests that states cap the security deposit at two months' rent for homes, require written agreements, and set up rent authorities for quick disputes. It applies only in states that adopt it, so check your state's rent law.
Renewing after 11 months
At the end of 11 months, sign a fresh agreement with new dates and pay stamp duty again. Don't just continue without a document — if a dispute comes up, an expired agreement is weak evidence.
Frequently asked questions
Can I make a rent agreement online?
Yes. Several states and private services let you create an e-stamped agreement online. In Maharashtra you can also complete registration online with Aadhaar-based e-signatures.
Is a notarised agreement enough?
Notarisation only confirms signatures; it doesn't replace stamp duty or compulsory registration. Make sure the agreement is properly stamped first.
Can the landlord keep my deposit?
Only to cover unpaid rent or damage beyond normal wear and tear, as written in the agreement. Ask for a written list of any deductions.
Who pays stamp duty, landlord or tenant?
It's usually paid by the tenant, but the agreement can say otherwise. Many landlords and tenants split it.
Do I need a rent agreement for HRA?
For HRA claims, your employer may ask for rent receipts and a rent agreement. If yearly rent is above ₹1 lakh, the landlord's PAN is also required.
Checklist before you sign
1. Check the landlord's ownership — ask for the sale deed, property tax receipt or electricity bill in their name.
2. Read the deposit refund clause: how many days after you leave, and what can be deducted.
3. Photograph every room and fitting on moving day and email the photos to the landlord.
4. Make sure the e-stamp value matches your state's rate and is in the right party's name.
5. Keep a signed copy with both signatures on every page, and pay rent only by bank transfer or UPI so every payment is recorded.
